Warranty protects you from manufacturing defects caused by improper milling, grading, staining and coating as long as you own your home. Damages due to improper transportation, storage, moisture, installation or any other cause are not covered,This warranty is applicable to replacing the material only in excess of 5%, excluding all other costs, such as transportation, installation, storage, cutting allowance, etc...
The warranty covers the finish for 25 years under normal residential traffic conditions. Warranty does not cover indentations, scratches or damages caused by negligence, water, stains, abuse, accidents, extreme environmental conditions, improper maintenance, insufficient protection and failure to follow manufacturer's installation instructions.
Installer/owner responsibility:
Beautiful hardwood floor is made from a natural product, wood. Therefore natural variations in color, tone and grain will be present and are not defects. Our flooring is manufactured in accordance with accepted industry standards which permit a defect tolerance not to exceed 5%. The defects maybe natural or that of the manufacturing. Prior to installation of any hardwood flooring product, the installer must determine that the job-site environment and the sub surfaces involved, meet or exceed all requirements as stipulated in installations instructions. The manufacturer declines any responsibility for job failure resulting from or associated with sub surface of job-site environment deficiencies. The installer/owner has final inspection responsibility as to grade, manufacturing and factory finish. He must use reasonable selectivity and hold out or cut off pieces with glaring defects whatever the cause. Use of stain or filler or putty stick for defect correction during installation should be accepted as normal procedure. When hardwood flooring is ordered, 5% must be added to the actual square footage for tolerated defects and the waste due to the cuts. Should an individual piece be doubtful as to grade, manufacturing or factory finish, the installer should not use the piece.
REGARDING ALL WARRANTY COVERAGES: ANY DAMAGE CAUSED TO THE FLOORING OR FINISH DUE TO THE FOLLOWING WILL VOID THIS WARRANTY:
Failure to Inspect: Each piece of the flooring is as unique as the trees from which they are made. Samples are made available only for representation of the general nature of the flooring and cannot be relied upon by a purchaser as an express warranty of product appearance, and cannot be duplicated or conformed to by Mistral Hardwood Floor Inc. in manufacturing character flooring. Unique natural characteristics are normal characteristics and are not construed as defects. We cannot and do not warrant against natural variations, nor the normal minor differences between color samples and the color of installed floors.
The uniqueness of each piece including, but not limited to each planks’ natural knot holes, color variations, grain deviations, mineral streaks, and openings in the surface, must be examined and inspected by buyer or buyers representative to determine its appearance and structural acceptability in the final floor. If any character trait of any piece of Mistral Hardwood Floor Inc. prefinished flooring is unacceptable, you may consider cutting it out of the piece of flooring before installation; although this is not grounds for replacement of the piece. Mistral Hardwood Floor Inc. will not be responsible for any liability including, but not limited to, repair, replacement or refund in any manner, for installation of character flooring that is objectionable or undesirable based on the character traits of the wood. It is the responsibility of the installer and/or the homeowner to inspect boards prior to installation. Mistral Hardwood Floor Inc. accepts no responsibility for costs of product or labor when boards with visible defects have been installed.
Installation of the product constitutes acceptance of all character deviations and occurrences in the product. This warranty does not extend to any repair, replacement, refund, or reimbursement remedies for reinstallation costs, labor, or material for replacement of product that was not properly inspected before installation for visual or structural defects that are eventually rejected by the end user or their agent.
Failure to Install Properly: If original installation is done by anyone other than a professional installation contractor, this warranty is invalid. This warranty does not extend to any repair, replacement, refund, or reimbursement remedies for reinstallation costs, labor, or material for replacement of product that was not properly installed.
National Wood Flooring Association and National Oak Flooring Manufacturers Association industry recommended installation procedures must be followed. These standards include, but are not limited to: moisture content must be tested on both the product and subfloor prior to installation; a 2 week minimum acclimation period is required upon delivery prior to installation; and a dry subfloor must be in place before installation. This warranty is void if a subfloor other than 5/8" thick or greater performance rated plywood, or 3/4" thick or greater performance rated OSB is used. NOFMA approved staples or nails must be used and placed not more than 5" on center.
Transportation and Storage: The product must be transported and stored in a dry environment. No exposure to moisture of any type should be permitted. Do not store on concrete surfaces.
Environmental Conditions: The humidity level in the home must be maintained in the range of 45%-55% throughout the year. Air conditioning, dehumidification or humidification may be necessary, to control the environmental humidity range, and maintain it in the desired range of 45%-55%, since excessive humidity beyond the range may cause individual board swelling, and humidity below the range (typical in late winter or desert climates), may cause individual board shrinking.
Normal exposure to sunlight will bring about changes in the shading of any hardwood floor as the floor ages. Cherry flooring naturally darkens with exposure to sunlight which is not considered a defect. Area rugs should be moved occasionally as they block sunlight and may give the appearance of discoloring under the rug. This is not a product defect.
Installation over radiant heat will void this warranty.
Abuse or Misuse: This warranty does not cover any damage that results from the accidental or intentional penetration of the finish. Nor does the warranty cover damage caused by shoes in need of repair, sports equipment, furniture, cleaning equipment, sudden impact by hard objects, pet claws, use of abrasive cleaners, or abrasion by any object such as sand or pebbles. Scratches that appear after installation are considered to be normal wear. Sanding or "screening" the finish will void this warranty.
Moisture: This warranty does not cover damage caused by moisture penetration, flooding, leaky plumbing, overflowed tubs or sinks, washing machines, dishwashers, or any similar damage.
Infestation: This warranty does not cover damage due to insect infestation after the product has left the factory.
Alterations or Changes in Composition of Product: Mistral Hardwood Floor Inc. will not be responsible for alterations to or changes in composition of Mistral products by anyone including, but not limited to: purchaser and their installers, by whatever means or methods employed by them, after the product is in the exclusive possession and control of purchaser or purchasers agents.
